Shoes Up! - Terms and Conditions

1. Acceptance of Terms 
   By downloading, installing, or using the "Shoes Up!" mobile application ("the App"), you ("the User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the App.
2.  Use of the App
• "Shoes Up!" is provided for your personal, non-commercial use. 
• You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the App by, any other person..
• You are responsible for ensuring your device meets the minimum requirements for the App.
• We reserve the right to modify or discontinue the App, or any portion thereof, at any time, with or without notice.
3. Data Privacy and Local Storage
• ""Shoes Up!" stores all user data, including any information you input, locally on your device. 
•  We do not collect or transmit any personal data from your device to our servers or any third parties. 
• You are solely responsible for the security and backup of the data stored within the App on your device. 
• If you delete the app, or clear the apps data, all data will be lost. 
• We have no access to, and are not responsible for, any data stored on your device.
4. User Responsibilities
• You are responsible for maintaining the confidentiality of any information you store within the App.
• You agree not to attempt to reverse engineer, decompile, or disassemble the App.
• You agree not to introduce any viruses, malware, or other harmful code into the App.
5. Intellectual Property
• The App and all its content, including but not limited to graphics, logos, and software, are owned by Elite DJs Perth or its licensors and are protected by copyright and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose.
6. Disclaimer Of Warranties
• The App is provided "as is" and "as available" without any warranties of any kind, either express or implied.
• We do not warrant that the App will be error-free, uninterrupted, or secure.
• We disclaim all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation Of Liability
• In no event shall Elite DJs Perth be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App.
• Because all data is stored locally, we are in no way responsible for data loss.
• Your use of the app is at your own risk.
8. Indemnification
• You agree to indemnify and hold harmless Elite DJs Perth from any claims, damages, or expenses arising out of or in connection with your use of the App or your breach of these Terms.
9. Changes To These Terms
• We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms in the App or on this website.
• Your continued use of the App after any changes constitutes your acceptance of the new Terms.
10. Governing Law
• These Terms shall be governed by and construed in accordance with the laws of Perth, Western Australia.
